TERMS OF SERVICE

These Terms apply to use of the Kiyora Beauty online store and consumer purchases made through it.

References to “we”, “us” and “our” mean the seller operating under the trading name Kiyora Beauty.

Nothing in these Terms excludes or restricts mandatory consumer rights.

1. ORDERS AND PAYMENT

You must have the legal capacity to enter into a purchase contract and provide accurate contact, billing and delivery information.

Use only payment methods you are authorised to use.

Submitting an order constitutes an offer to purchase. An automated receipt acknowledges your order. The contract is concluded when we expressly accept the order or confirm dispatch.

Before acceptance, we may decline an order for a legitimate reason, including unavailability, delivery restrictions or reasonably suspected fraud. Payments for orders we do not accept will be refunded without undue delay.

After acceptance, we will not substitute products or materially change the agreed price or conditions without your agreement.

1. PRICES AND PRODUCT INFORMATION

The applicable product description and price are those agreed when the purchase contract is concluded.

For EU consumer sales, displayed prices include applicable VAT. The currency, order total and any additional charges are disclosed before payment.

Minor colour differences may result from screen settings. This does not remove our obligation to supply goods that conform to their description.

If a material error is identified before acceptance, we will explain the correction and allow you to proceed on the corrected basis or cancel with a refund. Errors discovered after acceptance will be handled in accordance with applicable law.

1. DELIVERY

Delivery availability, costs and estimated periods are provided before purchase. Any expressly agreed delivery date takes priority over a general estimate.

For deliveries arranged by us, the risk of loss or damage remains with us until you or your nominated recipient, other than the carrier, physically receives the goods.

A statutory exception may apply where you independently appoint a carrier that we did not offer.

Contact us if delivery is delayed, damaged or missing. Circumstances outside our control do not automatically remove your rights to delivery, cancellation or other applicable remedies.

1. GENERAL PRODUCT SAFETY

Use each product only for its intended purpose and in accordance with its label, supplied instructions and applicable warnings.

Read all relevant age restrictions, contraindications, storage requirements and cleaning instructions before use.

If a product arrives without necessary instructions, or the instructions are unclear or inconsistent, contact us before using it.

Do not use a product that appears damaged, contaminated, defective or unsafe.

Keep products, small components and packaging away from children and pets. Follow product-specific supervision and age requirements.

1. COSMETICS AND PERSONAL CARE

Cosmetics intended for external use must not be swallowed or used internally.

Do not apply a product inside the eyes, mouth or other sensitive areas unless it is expressly intended for that use.

Check the ingredient list. Do not use products containing ingredients to which you have a known allergy.

Follow any manufacturer recommendation concerning a small-area tolerance test. Such a test cannot guarantee that an allergic reaction or irritation will not occur.

Stop use if irritation or another adverse reaction develops. Seek appropriate professional assistance where necessary.

Observe storage requirements, expiry dates and period-after-opening guidance. Do not alter a product or mix it with other substances unless the manufacturer permits it.

1. ELECTRICAL AND HEATED PRODUCTS

Use electrical products only with the power supply, accessories and settings specified for the exact model.

Follow all instructions concerning charging, water exposure, cleaning, cooling and storage.

A device’s water-resistance rating does not automatically apply to its charger or power adapter.

Do not use damaged devices, cables or chargers. Do not bypass safety features or attempt unauthorised modifications.

Heated components may cause burns. Avoid contact with heated parts and allow the product to cool before storage.

1. IPL, LIGHT-BASED, EMS AND MICROCURRENT DEVICES

These products are not suitable for everyone. Read the complete model-specific suitability guidance and contraindications before use.

Follow the manufacturer’s requirements concerning permitted body areas, skin and hair compatibility, settings, treatment frequency and eye protection.

Restrictions may apply because of health conditions, medicines, implanted devices or other individual circumstances. The applicable restrictions must be determined from the documentation for the exact model.

If suitability is unclear, do not use the product until clarification has been obtained. Professional advice does not override an express manufacturer prohibition.

Stop use if the device causes pain, a burn, visual disturbance or another adverse reaction. Seek appropriate assistance where necessary.

1. HEALTH INFORMATION AND RESULTS

General information provided by Kiyora Beauty does not replace individual medical or dental advice.

Do not stop prescribed treatment or delay professional assessment because of information on our website.

Any medical intended purpose or regulated status must be supported by the relevant product documentation.

Individual cosmetic results may vary. This does not excuse inaccurate advertising, unsupported performance claims or goods that do not conform to the purchase contract.

1. IMPROPER USE AND RESPONSIBILITY

To the extent permitted by applicable law, Kiyora Beauty is not responsible for harm to the extent that it is caused by use contrary to clear and appropriate instructions, use for an unintended purpose, improper storage or unauthorised alteration, and is not attributable to a product defect or a breach of our obligations.

Examples may include swallowing a cosmetic clearly intended for external use, using a device on an expressly prohibited body area or disregarding specified electrical safety instructions.

Whether improper use affects liability depends on the circumstances and applicable law. It does not automatically eliminate a consumer’s claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including applicable liability for defective products, inadequate warnings, fraud, intentional wrongdoing, gross negligence, death or personal injury.

1. PRODUCT-SAFETY REPORTS

Contact info@kiyora-beauty.com if a product causes an injury, an unexpected adverse reaction or appears unsafe.

Provide your order reference and a description of the problem where possible. Stop using a potentially unsafe product.

Do not send damaged batteries or other potentially hazardous items through ordinary post without obtaining appropriate return instructions.

Reporting a safety issue does not waive any legal rights.

1. WITHDRAWAL AND RETURNS

Unless a statutory exception applies, EU consumers may withdraw from an online purchase without giving a reason within 14 calendar days after receiving the goods.

Notify us within the applicable period by an unequivocal statement or an available online withdrawal function. Our approval is not required to exercise a statutory withdrawal right.

Return the goods within 14 days after notifying us.

Direct return costs are payable by you only where this was properly disclosed before purchase and applicable law permits it. Otherwise, those costs are borne by us.

Statutory refunds include the cost of the least expensive standard delivery offered and are made within 14 days after we receive the withdrawal notice. We may withhold reimbursement until the goods are received or you provide evidence of return, whichever occurs first, unless we have offered to collect them.

Refunds use the original payment method unless another method is expressly agreed without additional cost to you.

You may inspect goods to establish their nature, characteristics and functioning. Where the law permits, you may be responsible for diminished value resulting from handling beyond that necessary inspection.

The hygiene exception applies only to sealed goods genuinely unsuitable for return for health-protection or hygiene reasons that have been unsealed after delivery. It does not automatically exclude all cosmetics or beauty tools.

A sale price does not remove statutory withdrawal rights. Additional voluntary return offers do not restrict mandatory rights.

1. DEFECTIVE OR NON-CONFORMING GOODS

Products must conform to the purchase contract and applicable legal requirements.

Consumers retain the applicable legal guarantee and rights to remedies for defective or non-conforming goods, including repair, replacement, price reduction or termination with a refund where the legal conditions are met.

Necessary costs of legally required remedies are borne by us.

Opening packaging or a hygiene seal does not remove rights relating to a defect. Failure to report a problem immediately does not automatically extinguish legal rights.

You are not required to pursue the manufacturer instead of us.

1. WEBSITE USE AND INTELLECTUAL PROPERTY

Do not use the website for fraud, harassment, unlawful activity or interference with its security.

Keep account credentials confidential and notify us of suspected unauthorised access.

Website content, trademarks and other intellectual property belong to their respective rights holders. Using the store does not transfer ownership of those rights.

Reviews and other submitted content must be lawful and must not infringe the rights of others. We may format published reviews without changing their meaning.

1. THIRD-PARTY SERVICES

Shopify provides the commerce platform. Purchases are made from the seller operating as Kiyora Beauty.

The involvement of Shopify, payment providers, carriers or other service providers does not remove mandatory rights against the legally responsible party.

1. PRIVACY

Personal information is handled as described in our Privacy Policy.

Placing an order or accepting these Terms does not automatically constitute consent to optional marketing or tracking.

1. COMPLAINTS AND APPLICABLE LAW

Send complaints to info@kiyora-beauty.com with your order reference and a description of the issue.

Applicable law and jurisdiction are determined by the relevant legal rules. Nothing in these Terms deprives consumers of mandatory protections or access to competent courts.

Consumers are not required to waive legal rights or indemnify us merely for making a complaint or pursuing a lawful claim.

1. CHANGES TO THESE TERMS

The Terms applicable when your purchase contract was concluded continue to govern that order.

Later changes apply prospectively. If a provision is unenforceable, the remaining provisions continue only to the extent permitted by law.
